These Terms of Service ("Terms") govern your use of the AeroWX mobile application (the "App") operated by AeroWX ("we", "us", or "our"). By downloading or using the App you agree to these Terms.
1. The Service
AeroWX is an iOS and Android aviation weather application that aggregates and displays METAR, TAF, NOTAM, SIGMET, AIRMET, ATIS, and related data from publicly available aviation weather sources including the FAA, NOAA Aviation Weather Center, and other government agencies.
The App is intended for use by pilots, student pilots, aviation enthusiasts, and aviation professionals as a supplemental reference tool.
2. Accounts and Eligibility
AeroWX does not require you to create an account. You must be at least 13 years old to use the App. By using the App you represent that you meet this requirement.
3. Free Trial
New users receive a 7-day free trial of AeroWX Pro features, beginning on the date the App is first launched. No payment is required to start the trial. The trial period provides access to Pro features including interactive weather overlays, NOTAMs, and ATIS.
If you subscribe during the trial period, billing begins immediately upon purchase — the trial clock does not extend your billing date. The remaining trial days are forfeited when you subscribe.
After the trial expires, access to Pro features is locked until you subscribe.
4. Subscriptions and Billing
AeroWX Pro is available as an auto-renewing subscription:
- Annual — billed once per year
- Monthly — billed once per month
Prices are displayed in your local currency at the time of purchase and are set by the App Store or Google Play in your region. Prices may change; you will be notified in advance of any price increase that requires your consent.
Your subscription automatically renews unless you cancel at least 24 hours before the end of the current billing period. Your Apple ID or Google Play account is charged at confirmation of purchase and at the start of each renewal period.
5. Cancellation
You may cancel your subscription at any time through iOS Settings → [Your Name] → Subscriptions → AeroWX (iOS) or Google Play → Subscriptions → AeroWX (Android). Cancellation takes effect at the end of the current billing period; you retain access to Pro features until that date. We do not offer pro-rated refunds for unused subscription time.
Refund requests for App Store purchases must be submitted to Apple at reportaproblem.apple.com. Refund requests for Google Play purchases must be submitted to Google at Google Play support. We do not process refunds directly.
6. Restoring Purchases
If you reinstall the App or use it on a new device, your purchase is restored automatically on Android. On iOS, tap Restore Purchase in the subscription screen if your subscription is not recognised. Restore requires an internet connection.
7. Acceptable Use
You agree not to:
- Reverse engineer, decompile, or disassemble the App
- Scrape, reproduce, or redistribute aviation data obtained through the App for commercial purposes
- Use the App in any way that violates applicable law
- Attempt to gain unauthorised access to our backend systems
8. Aviation Data Disclaimer
All weather and NOTAM data displayed in AeroWX is sourced from government and third-party providers (FAA, NOAA, etc.) and is provided "as is". We make no representation as to the accuracy, completeness, timeliness, or fitness for purpose of any data displayed.
AeroWX is not a certified aeronautical information service. Do not use AeroWX as your sole source of weather or NOTAM information for flight operations. Always obtain official pre-flight briefings through authorised channels (e.g., 1800wxbrief.com, official ATC briefing services).
We are not liable for any loss, injury, or damage arising from reliance on data provided by the App.
9. Intellectual Property
The App, including its design, code, and branding, is owned by AeroWX and is protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the App on your personal iOS or Android devices for your personal, non-commercial use.
Aviation data (METARs, TAFs, NOTAMs, etc.) is sourced from government agencies and is in the public domain. The App's presentation and curation of that data remains our intellectual property.
10. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free from harmful components.
11. Limitation of Liability
To the maximum extent permitted by applicable law, AeroWX and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of data, personal injury, property damage, or loss of life — arising out of or related to your use of the App or reliance on data displayed by the App, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid for the App in the twelve months preceding the claim.
12. Changes to the App and Terms
We reserve the right to modify, suspend, or discontinue the App or any feature at any time without notice. We may update these Terms from time to time; the updated Terms will be posted with a revised effective date. Continued use of the App after changes constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of the jurisdiction in which AeroWX is registered, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the competent courts of that jurisdiction.
